on top of this shot from our sutro camera. it will be a nice day today if you like it sunny and mild. starting out with temperatures in the 40s around the bay. still a little cool in the north bay, but already we are much warmer than we were yesterday. we are on our way to a warmup that's going to last for the next couple of days. we have partly cloudy skies around the bay this morning and temperatures are mainly in the 40s. san francisco edging in on 50 degrees right now. so we are going to keep this weather with us for the next couple of days. but we have much cooler air and a wintry looking storm headed our way midweek. i'll talk about it a bit later. carolyn. >> thank you, lisa. >> there is a growing controversy this morning just as their holiday drive kicks into high gear. the salvation army is being accused of being anti-gay. a student group at berkeley is making that caligation. we are joined live from the cal

campus with the details. good morning. >> good morning, carolyn. as you mentioned, student leaders here at u.c. berkeley say that the salvation army is anti-guy, critting what they say is years of discrimination, including an interview where they said the salvation army said, quote, according to scripture, gays must die." so they don't want them on campus and don't want their fellow students supporting it. it started by banning salvation army bell ringers on campus this holiday season. that came after they said they discriminated against lgbt groups. now they want donation boxes removed from the dorms. they have mixed reaction against the push. >> we've been kind of supportive

of that, but i didn't know that they were anti-gay or homophobic so that kind of makes it questionable. >> donating to the salvation army doesn't mean that you are prejudice against gays and lesbians. it just means you want to help people. >> in a statement to the news the charity said, quote, the salvation army believes all people are equal, regardless of sexual orientation. we firmly oppose mistreatment of lgbt persons. it ultimately will be up to university officials to decide whether to ban those two clothing donation bins. reporting live in berkeley, abc7 news. >> all right. we will monitor those developments. thank you. today is the first day many saim sex couples can legally marry under a new law in washington state. voters approved saim section marriage last month and the new law took effect on thursday when people lined up for marriage licenses.

washington law requires all couples wait three days to get hitched, meaning today is the first day same sex weddings can take place. three days is not a long delay for some couples who say they have waited for decades for this day to arrive. oakland police are trying to find a killer who shot a man to death in broad daylight in jack london square. it happened yesterday. it was the third homicide this weekend in oakland. john alston said the shooting has raised concerns about growing crime in oakland. >> nearly four hours after the killing the victim's body was removed and oakland police opened up third street between broadway and franklin. the mid-afternoon shooting took place a few blocks to the entrance to jack london square where she just attended a social event. >> i feel unsafe in oakland. there's a lot going on and i'm afraid for my children to walk

by themselves. i feel it's not older, younger, no one is safe. >> the crime scene is only about four blocks from police headquarters. officers happened to be in the middle of roll call and they got here rather quickly. >> they found a man in the middle of third street who was shot to death by apparently someone who escaped in a vehicle. police don't believe it was a random attack. some residents heard the gunshots. >> i was just thinking that noise we heard could have been gunshots. it was pretty loud.sounded like a couple firecrackers going off actually. >> detectives hoped to see what happened by look at surveillance from a condominium overlooking the crime scene. there were onlookers, including a seminary student from the east coast with the idea of possibly moving here. >> i'm from d.c. where in the '90s we had all kinds of acts of random violence so this is

not something that would dissuade me that contemplating living in the city of oakland because i've seen the rapid turn around the district of columbia has had. >> for oakland this was the third homicide in just two days. john alston, abc7 news. oakland police are now teaming with other law enforcement agencies and a private security company to expand patrols in high crime areas. shopping districts in monte clare, piedmont, lakeshore and other areas have seen a rise in burglaries, robbings and muggings. the understaffed police force need all the help they can get, including patrols from bay alarm companies in business and residential areas. >> we see a lot of the various alarm companies driving up and down our street where we live. >> i think it will work. very good idea. pool the resources. >> oakland police are also depending on the alameda county

sheriff's office, the hp and bart police to help fight the rise in crime. san jose police say last night's christmas in the park celebration was marred by the stabbing of a 14-year-old. he is in the hospital, expecting to survive cuts to his chest and arm. it's highly unusual for violence to occur at christmas in the park that attracts half a million. visitors every year. in san francisco officers say five men, at least one of them armed, terrorized people in a home invasion. it happened on 31 avenue between

clement street. a neighbor said he heard screams coming from the house. by the time officers arrived the men were gone and they got away with a number of items from the house. >> an armed man police say took two women hostage during an attempted robbery is recovering this morning after being shot by officers. cameras caught the smoke of a concussion grenade fired by police into a jack in the box yesterday. a hostage was rushed to safety by police. the gunman's condition is not known. the incident began at 12:30 when police received a call after be -- of a robbery in progress. a four hour standoff resulted. the other hostage was also safely released. in concord a grocery store will be open today after being forced to close last night because of a strong chemical smell. it happened at the food max on monument boulevard. the fire department got a call around 4:30 yesterday afternoon about people who said their eyes were burning and they were having trouble breathing. >> of the 20 people treated at

the scene, no one wanted to be transported so they were all treated and released. it went away. the hazmat team checked everything out and the store reopened by seven. no word on what caused the incident. the man who is charged with murder of the missing morgan hill teenager is scheduled to return to court tomorrow to face additional kidnapping charges. they are connected to three 2009 incidents investigators say happened when they say anthony torres was 17 years old. one involved a stun gun. torres was arrested in may for sierra lamar's murder based on dna evidence. last night a fundraiser was held to support ongoing efforts to find her. the ice skate event took place at sharks ice. organizers are still holding out hope for lamar's safe return. her body has not been found. she vanished back on march 16th while walking from home to her school bus stop.

the union city woman convicted of killing nursing student michelle lee will be sentenced tomorrow. the sentence will require her to spend a minimum of 25 years in prison after an alameda county jury convicted her of first-degree murder. that was in october. the nursing student went missing in may of last year and then her body was found in a remote canyon. prosecutors say esteban killed her in a rage over esteban's ex-boyfriend. >> coming up, new developments in egypt. the changes the embattled president says he will make, but will it be enough to ease tensions? and people in south africa are worried about the health of former president nelson mandela he has been

san bernardino police are investigating the fatal shooting of a student by state california police. the officers were called to an off-campus dormatory about a disturbance. investigators say they confronted a male student in the dorm hallway and that he put up a fight. police say they shot him when they feared for their own safety. one officer was checked at a hospital for nonlife-threatening injuries. and an american doctor abducted by the taliban in afghanistan was rescued.

officials tell abc news it was a special operations rescue. no americans died in the raid. several taliban were killed. joseph was beaten severely and he will be rejoining his family. no word on why he was abducted. in egypt president mohamed morsi is listening and will agree to rescind some of the near absolute powers he granted himself. however, he has not delayed a referendum on a new constitution at critics wanted. his moves come after a rally in san francisco yesterday by egyptian americans. protesters don't want morsi removed from office, but say his power grab is not the way a democracy should run. >> i'm not accepting all the new decisions by the president morsi, and we want more equality for all egyptians, not just the muslim brotherhood. >> the muslim brotherhood is

morsi's political party. morsi granted himself power to declare emergency laws and to not be accountable to the judiciary. venezuelan president hugo chavez will undergo surgery for cancer for the third time. chavez is going to cuba today for that surgery. last june he had surgery for an unspecified type of pelvic cancer. in february the 58-year-old president had surgery again for a tumor in the same area. he won re-election back in october. former south african president nelson mandela is said to be comfortable had and in good care in a hospital. south african president jacob zuma visited the 94-year-old mandela who is undergoing tests for an undisclosed condition. last year he was hospitalized for a respiratory infection. mandela became president of south africa in 1994 after spending 27 years in prison while fighting racist white

regime. a key gop senator this morning said this morning they might support a higher tax rate for wealthier americans but it can only come in democrats agree to reform medicare and other major entitlement programs. such a compromise would represent the first real movement in the stalled talks on capitol hill to try to keep the country from plunge over a fiscal cliff come the first of the year. that's what major program cuts and tax hikes on all americans would automatically kick in unless there's a deal. >> everybody in this country will have to participate in some discomfort if we are to going to get out of this. and longs we continue to lie to the american people that you can solve this problem without adjusting and working on those programs, it is dishonest beneath anybody in washington. >> but right now the only thing i hear, the only thing we see is

middle class families being asked over and over again to be the ones who have the burden in solving this problem and we are saying no. >> so you see those congressional members debating this morning on abc this week with george stephanopoulos. so far both parties have held a lot of news conferences to posture their talks but george stephanopoulos said there's been less than one hour of serious negotiating. lisa argen is here with a preview of the accuweather forecast. not looking too serious out there. >> no. it's calm. emeryville, very quiet, 53 degrees. 54 at sfo and 56 in san jose. those temperatures are really where we should be for highs this time of year so we are above normal. we will talk about it next. >> all right. also next, de la salle puts another trophy in their high

>> this time last week we were getting a pounding with the wind and the rain and the wicked weather, but we can't say that today. >> no. in fact it's pretty mild out there. the winds are quite gusty. gusts up to 60 miles an hour on top of mt. diablo. it's freezing at the tahoe valley airport. going to a high of 44 this afternoon. new snow? yes, looks-like he wednesday we will get a dusting. in fact, the foothills will see -- the lower elevations will see snow around california, in fact down to 3 enthusiast feet through the middle part of the week. here we are at about 2500 feet. mount tam, you see a bit of a breeze there, but more gusts will be on the way. in fact, those north, northeast winds will bring down slightly warmer air, although the mixing that is occurring right now is

really offset by some of the higher clouds around the bay. so we are looking at kind of a mixed bag out there. but overall we will see a pleasant couple of days. a warmer start to the week. here's a look at live doppler 7 hd. you notice picking up a little bit in the way of high cirrus clouds. you see 57 degrees at half moon bay. you may have felt the gusty winds if you are out for a morning jog or bike ride around mt. diablo because those winds have also worked to really scour out any fog that wanted to move into the east bay valley. we haven't seen any of that. we are looking at much warmer temperatures compared to yesterday. 11 degrees warmer in fremont and livermore with the north bay even warmer as well. we still saw some 30s this morning. chilly in napa. cloudy and a warmer day today and tomorrow. cooler weather heads our way on

tuesday and with that we will look for a storm system to arrive on wednesday. it's a fast mover. anywhere from a quarter of an inch to three quarters of an inch of rain is anticipated for wednesday into thursday in the north bay. high temperatures today in the 60s. that's a little bit above normal. we should be in the upper 50s, to about 60. so a modest warmup today and tomorrow. and that's due to a slight offshore flow compliments of a ridge of high pressure that is building in to the eastern pacific, and as it does we are looking at that flow bringing some gusty winds down from the higher elevations. and also with the setup like this we are looking for a high fire danger in san diego. so really much of california will be dominated by this area of high pressure which deflects the storm systems to the north and brings that sustenance and dryer, warmer air our way. fast forwarding into tuesday night, 9:00, we have rain in

sonoma county, and by wednesday, before the morning commute, looks like we will see some pretty good rain burks then it moves quickly out of here by the afternoon. 64 today in fremont with 65 in san jose. the niners today will look for very mild conditions with 60. a little breezy. 63 watsonville. the look ahead, the breezy winds taking us through tomorrow with some mild conditions and then cooler tuesday. a look at the numbers struggling to make it into the mid-and upper 50s wednesday. much cooler air accompanied by rain, mountain snow, and looks like next weekend will be wet, too. i've added rain to that. it looks more unsettled into the middle of december. we will get some real cold weather maybe. >> other parts of the country really in a deep freeze. >> big time midwest, yeah. >> thank you, lisa. as you said, it's going to be nice today for the 49ers. they are playing the miami dolphins at 105 at candlestick park. they are teaming up with operation dream, a local

nonprofit to collect toys and cash for needy children. last year fans donated more than 20,000 toys for local kids. you can bring a new unwrapped toy to donate. please, no toy guns or weapons for obvious security reasons. cash is also accepted. volunteers will have collection buckets in the parking lot near the stadium entrances. in sports next weekend, de la salle high school will go for the state title for the fourth year in a row after blowing folsom high school in sacramento. here's schu with the highlights in sports. >> good morning. kickoff with a little high school football. de la salle faced off against folsom. four minutes in. punches it in from three yards out. 7-0, spartans. second quarter. fourth and goal, and the lefty finds buckley in the end zone.

in a few hours the dallas cowboys will play in cincinnati, one day after their defensive lineman josh brent was charged with intoxicated manslaughter. authorities say he was driving at a high rate of speed and lost control. brent will be in court today for a bail hearing after a crash that flipped his car and killed a teammate. abc news reporter clayton sandel has the latest. >> police say dallas cowboys player josh brent was speeding down this road after 2:00 a.m. saturday when his mercedes crashed, flipped and caught fire. in the passenger's seat, brent's teammate, jerry brown. >> when officers arrived on scene, mr. brent was removing or dragging mr. brown from the vehicle. >> brent was given and failed field sobriety tests. brown was rushed to a hospital where he died. >> once our officers learned that mr. brown had passed away, then mr. price brent was under

arrest for intoxication manslaughter. >> on behalf of josh, a tremendous loss to him. this was like losing a little brother. >> it's not the first time brent was charged with drinking and driving. he was sentenced in college and sentenced to 60 days behind bars. from his jail cell overnight brent said i will live with this tragic and horrific loss every day the rest of my life. it has been a tragic week for the nfl. last week kansas city chiefs player belcher killed his girlfriend and then himself, leaving his daughter an orphan. and after belcher had been drinking but since he wasn't driving, police cut him a break. >> all right. you have a good one. >> with no way of knowing what he was about to do. clayton ssandel, denver. >> state lawmakers are deciding

how to dole out money to help schools become more energy efficient. abc7 news capital correspondent nannette miranda has more on what's happening. >> we want to be first in line, somehow, some way. >> this principal is pleading his case to give his campus some of the new energy retrofit money. 73% of the public schools are more than 25 years old and in need of the funding badly to upgrade or replace windows, in inefficient lighting and old air conditioning and heating systems. >> if we can look at energy efficiencies then you are having year over year over year and in the long run you will have more money available for those things you need. >> the costs are staggering. more than 10,000 public schools in california together spend $700 million a year on energy. that's how much they spend on all books and supplies. thanks to voters who overwhelmingly approved proposition 39 last month, disadvantaged schools will now be able to pay for energy retro fits.

proposition 39 closes a tax loophole that mostly benefited out-of-state corporations. it's a billion dollars a year funding boost for the state. half goes to the general fund and the other half to the energy needs of schools which could mean no more putty around the window sil. >> the old putty has been there forever. >> or single-pane windows that make the classrooms saunas in the summer and freezers in the winter. science teacher hugh hunter says it hinders learning. >> as kids go from classroom to classroom they experience the same situation and after three or four hours of that it's hard for them to focus. >> lawmakers just introduced measures to get project moneys out the door by next summer. retrofitting is expected to cut energy costs at least 30%. >> we want to give them great, new energy efficiency and clean energy technologies and bring our schools up to the 21st century.

when the upgrading is done, the $4 billion goes to the state's general fund. in sacramento, nannette miranda, abc7 news. muni officials are hoping san francisco cable cars will be running smoothly today without any more problems. a series of glitches forced closers the past two days. service was shut down friday and after repairs were made to the cables, service resumed yesterday morning. but then around 8:30 the powell mason and powell height lines went down. the mta is blaming equipment issues for both disruptions. >> just two days after kate middleton was released from the hospital. she made a flashy first appearance yesterday. the family of the nurse fooled by the radio prank is speaking out. we have both stories from london. >> prince william went solo last night at a charity ball. his first public function since his wife's pregnancy was

announced. a conversation he equipped about kate's illness. i don't know why they call it morning sickness. they should call it all day and all night sickness. he did not talk about the tragic death and apparent suicide of the nurse who fell victim to the hoax call. but he and kate have issued a statement of sympathy for the family. she came to the country from india nine years ago with her husband and two children. her 14-year-old daughter wrote on facebook simply i miss you, i love you. she worked at the hospital as a private nurse for four years. her husband lived 100 miles away on bristol. while on shift she slept in a residence for nurses. with no reception on duty overnight she answered the prank call and put it through. >> mellow, could i speak to kate, my grand daughter? >> oh, yes. >> the embarrassment and humiliation appear to have driven her to suicide. for kate it is yet another test

of her new life as a very public royal. in september a tabloid photographer using an extremely long lens photographed her topless on a private vacation. >> while she understood what she was taking on, i think that there has been a couple of things that will have made them, oh, my goodness, we didn't really necessarily think it was going to be as bad in this day and age. >> it is sounding uncomfortablably like the life of her late mother-in-law, princess diana, who was hounded by the media. >> kate is understandably lying low. she had been scheduled to appear at the london premiere of "the hobbit" this wednesday but that will depend on her medical condition. jeffrey cough marks abc news, london. >> in southern california a dead whale has been towed out to sea after rotting on a beach for nearly a week. the whale washed up monday on a beach in malibu.

>> welcome back, everyone. finding a parking spot in downtown san mateo could now be a little easier if you download a new free smartphone app. abc7 news reporter jonathan bloom has more on how some bay area cities are teaming up with tech companies to make life easier for drivers. >> it's lunchtime in downtown san mateo. drivers inch along bumper to bumper searching for parking. >> ucla did a study and estimated that people spend about 15 to 20 minutes on average looking for a place to park. >> that's why kelly's company streetline spent years developing this senser. it detectives if a parking space is empty. san francisco started installing them two years ago and now san mateo has partnered with cisco to roll them out along with a free mobile map called parker. >> it's not they can't find parking, it's simply they don't know where it is. >> parking acts like radar,

guiding you to the most open spots. >> parking ahead. >> it's makers say it could reduce traffic. >> when you can take people's parking time from 20 minutes to 5 minutes, you are going to dramatically reduce the number of cars on the street. >> city officials think it's a good investment for taxpayers. >> it's much cheaper to efficiently manage your existing parking inventory than building new spaces and new facilities. installing one of these is as simple as drilling a hole and dropping it in. they are wireless, but unlike your cell own the battery life in these are measured in years, not hours. >> that's why cisco said this is just the beginning. they see cities becoming more liveable by putting the smart sensors on every piece of infrastructure. >> the kiosk here, the streetlight, the sewer there. all of the things should be connected. >> and street line has big plans of its own. soon building smart radar directly into cars and navigation systems. >> once you get to your destination, you can't leave your car in the middle of the street. you have to put it in a parking

and at the surface it won't be that windy. here's a look at san jose. 56 degrees under sunny skies and further up we go on the peninsula with more sunshine, low 50s, san mateo bridge. and from our sutro camera you see the beautiful conditions. it doesn't look windy here at all but it's up above 1500 feet where we have winds of 30, 35 miles an hour and then you get up to about 3,000 feet and that's where you have the 60 to 65, 70 miles an hour wind gusts. it's high pressure building in to the eastern pacific and that's aiding in our warm trend and allowing for the dry northerly winds at the surface and that's a little mini warmup we have in store for today and tomorrow. 56 in fremont, as well as mountain view with 57. it's been pretty mild all morning long at the coast. 43 san rafael. we are looking at temperatures this morning significantly warmer than we were yesterday. yesterday we had the fog. we still have 40s this morning in napa and santa rosa, even livermore. but since then the win has

allowed for better mixing and that mild air coming into play with the warmer air mass bringing temperatures a bit above normal today, tomorrow, but cooler weather, and a wind shift with stronger on shore winds on tuesday. that will bring the temperatures back into the 50s and then a pretty wet weather maker, a cold one, arrives on wednesday. it looks like it might mess with your wednesday morning commute, as well. you notice the clouds as they move around this big ridge of high pressure, and as they do it's allowing for the winds in the higher elevations, that sinking, subsiding air and warming as we get down to the surface. so as high pressure stays with us the next couple days, it keeps the storm track well up into canada. we are looking not only at the milder weather here, but, in fact, gusty winds in southern california where there is a fire weather watch for san diego. so experiencing unusually warmer weather with plenty of 60s. less tulie fog and numbers in

the mid-40s in the sierra nevada. this morning they dropped into the 20s so still making snow and making it possible for mother nature to get into the act tuesday night. by 3:00 wednesday morning, in fact, for the morning commute it looks like the rain will be pushing through the bay area and really bringing a chill around here. today, though, plenty of sunshine and very mild throughout with 65 san jose, 64 livermore. 63 downtown. across the bay in oakland, a very nice 65 and plenty of events going on around the bay today. very seasonal, festive activities. but you don't have to worry about the rain gear for the next several days. wednesday should be a cold and rainy day. leftover showers thursday. friday doesn't look too bad. looks like more rain heads our way by next weekend. so a little bit of a warming trend getting underway today. >> and we are still a couple

tonight the jewish community celebrates the second day of hanukkah. last night in san francisco's union square, a huge crowd saw the lighting of the first candle on a 25-foot mahogany menorah. a candle is going to be lit every day during the eight-day festival. the second candle will be lit at 4:30 this afternoon at union square. hanukkah celebrates the victory of an outnumbered jewish army over the syrians in the second century bc. >> around 4:30 it should be very nice, right, lisa? >> yes. temperatures dropping to the upper 50s downtown, but the high in san francisco, 63 today. elsewhere around the bay it should be pretty nice out there. you can see the winds blowing from mount tam, so higher elevations experiencing wind gusts from 30 miles an hour all the way up to 60 miles an hour. so if you are up in the hills for a bike ride, you will notice those gusty winds. at the surface lighter northeast winds, allowing for the warmup
